AI use clause for freelancers

An AI use clause: whether AI tools may be used in the work, disclosure to the client, and what that means for ownership.

AI use clause: copy and adapt

The Provider may use AI-assisted tools in producing the deliverables, provided that: (a) the Client's confidential information is not entered into tools that use it to train models; (b) the Provider reviews and takes responsibility for all output; and (c) the Provider discloses on request which parts of the deliverables were materially generated by AI. The Client acknowledges that purely AI-generated material may not be protected by copyright in some jurisdictions.

When to use it

In any creative or technical contract today. Clients increasingly ask about AI; answering in the contract builds trust and prevents disputes over ownership.

Variants by trade

No AI

The Provider will not use generative AI tools to create any part of the deliverables. All work is original and produced by the Provider.

Developers

AI coding assistants may be used. All generated code is reviewed, tested and covered by the same warranty as the rest of the deliverables.

Frequently asked questions

Can AI-generated work be copyrighted?

In the US and several other countries, content generated purely by AI without human authorship isn't protected. Work substantially shaped by a human generally is.

Do I have to tell clients I use AI?

Only if your contract or local law requires it. Stating your policy up front is simpler than explaining it after a client finds out.
