Clinch

E-signature legality · Europe

Is electronic signature legal in Austria?

Yes. As an EU member state, Austria applies the eIDAS Regulation directly: a simple electronic signature is admissible as evidence and cannot be refused just because it is electronic, while a qualified electronic signature (QES) has the same effect as a handwritten one. Most commercial contracts in Austria have no form requirement at all, so an e-signed service agreement, NDA or freelance contract is binding.

The law

  • eIDAS Regulation (EU) No 910/2014, as amended by Regulation (EU) 2024/1183 — Article 25: an electronic signature cannot be denied legal effect solely because it is electronic
  • Signatur- und Vertrauensdienstegesetz (SVG)
  • ABGB § 886 — a QES satisfies the written-form requirement

What still needs wet ink, a notary or a qualified signature

  • Acts requiring a notarial deed (Notariatsakt)
  • Wills and other dispositions upon death
  • Guarantees by consumers and other declarations where the law requires handwriting

Where Clinch fits

Clinch is built for everyday commercial agreements — freelance and agency contracts, statements of work, NDAs, quotes and service agreements — which in Austrianeed no special form. Every signature is captured with the signer's explicit consent, and the signed PDF carries an audit trail (name, email, timestamp of every event, hashed IP) plus a SHA-256 fingerprint of the exact document, so anyone can check it was not changed after signing.

It is a simple electronic signature, not a qualified one: for the documents listed above, use the formality the law requires.
