E-signature legality · Americas
Is electronic signature legal in Argentina?
Yes, with a nuance. A certified firma digital satisfies any legal signature requirement. A plain firma electrónica is valid but, if contested, the party relying on it must prove its authorship — which is why an audit trail matters. Most service contracts have no mandatory form.
The law
- Ley 25.506 de Firma Digital (2001) — distinguishes firma digital (certified) from firma electrónica
- Código Civil y Comercial de la Nación, arts. 286–288
What still needs wet ink, a notary or a qualified signature
- Acts requiring a public deed (escritura pública), including real estate transfers
- Wills and acts of last will
- Family-law acts and acts that by their nature require presence
Where Clinch fits
Clinch is built for everyday commercial agreements — freelance and agency contracts, statements of work, NDAs, quotes and service agreements — which in Argentinaneed no special form. Every signature is captured with the signer's explicit consent, and the signed PDF carries an audit trail (name, email, timestamp of every event, hashed IP) plus a SHA-256 fingerprint of the exact document, so anyone can check it was not changed after signing.
It is a simple electronic signature, not a qualified one: for the documents listed above, use the formality the law requires.
