Personal Training Contract Template

A personal training contract has to do something most freelance contracts don't: deal with physical risk. Before the first session, the client should confirm they're fit to exercise, tell you about injuries and conditions, and accept that training carries some risk of injury. This template covers session packages and expiry, late cancellations, the health disclosure and medical clearance, assumption of risk, and the plain fact that results depend on the client. Training Package

The Sender will provide personal training as described in a full redesign of the Acme Bakery marketing website, including a new homepage, menu page, and online ordering integration, including the number and length of sessions and where they take place. Sessions are valid until October 24, 2026; unused sessions expire after that date unless the Sender agrees to extend them.

Health Disclosure

Before the first session, the Client confirms they are physically able to exercise and will disclose any injuries, medical conditions, medications, or pregnancy that could affect training. If there is any doubt, the Client will obtain clearance from a doctor. The Client will tell the Sender promptly about any change in their health and will stop and inform the Sender if they feel pain, dizziness, or discomfort during a session.

Assumption of Risk

The Client understands that physical exercise carries an inherent risk of injury and voluntarily accepts that risk. The Sender will design sessions with reasonable care for the Client's disclosed condition. To the extent permitted by law, the Sender is not liable for injuries arising from undisclosed conditions, from ignoring the Sender's instructions, or from exercise the Client does outside supervised sessions. Nothing in this agreement limits liability for gross negligence.

Cancellations & Results

Sessions cancelled with less than 24 hours' notice, or missed, count as used. Fitness, weight, and performance results depend on the Client's consistency, nutrition, sleep, and health, and are not guaranteed.

Payment Terms

The total fee for this engagement is $2,400.00. Packages are paid in full before the first session.

A deposit of $720.00 is due before work begins. The remaining balance is due upon completion and delivery of the final work, unless otherwise agreed in writing.

Invoices are payable within 7 days of receipt. Late payments may accrue a 1.5% monthly late fee, and work may be paused until outstanding balances are settled.

Termination

Either party may terminate this agreement with 14 days' written notice. If the Client terminates before completion, the Sender will be paid for all work completed up to the termination date, and the deposit is non-refundable.

If the Sender terminates, any portion of the deposit exceeding the value of work already completed will be refunded to the Client within 14 days.

Independent Contractor Relationship

The Sender is engaged as an independent contractor, not an employee, partner, or agent of the Client. The Sender is responsible for their own taxes, insurance, and benefits, and is free to accept other engagements during the term of this agreement, provided they do not conflict with the confidentiality obligations above.

Governing Law & Entire Agreement

This agreement is governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

This document represents the entire agreement between the parties regarding a full redesign of the Acme Bakery marketing website, including a new homepage, menu page, and online ordering integration and supersedes any prior discussions or proposals. Any changes must be made in writing and agreed to by both parties.

FAQ

Do personal trainers need a waiver in their contract?

It's strongly recommended. This template includes a health disclosure and an assumption-of-risk clause. Waivers never cover gross negligence, and the rules vary by state and country, so treat this as a solid base.

Can training packages expire?

Yes, if the contract says so. This template makes sessions valid until the date you set, and lets you extend them at your discretion (for an injury, for example).

What if a client doesn't lose weight?

The Cancellations & Results clause says results depend on the client and aren't guaranteed, which is the honest answer.
